1. Introduction and Acceptance

By accessing or using TuSchool (hereafter referred to as "the Platform"), you hereby agree to be bound by these Terms and Conditions (hereafter referred to as "T&C"). These T&C, along with any other terms, conditions, or policies referenced herein or provided by the Platform, form a legally binding agreement between the user ("you" or "your") and the Platform. By using the Platform, you signify that you have read, understood, and agree to be bound by these T&C in their entirety. If you do not agree to these terms, you must refrain from using the Platform.

The Platform reserves the right, at its sole discretion, to update, amend, modify, or change these T&C at any time without prior notice. We will, however, notify users of any significant changes via email or through an announcement on the Platform. Users are encouraged to periodically review these T&C for any changes, as continued use of the Platform following such changes constitutes acceptance of those changes.

Failure to comply with any part of these T&C may result in suspension or termination of your access to the Platform, without any obligation on the part of the Platform to provide compensation, refunds, or further service to you. 2. Eligibility and Account Registration

The Platform is available for use by individuals, educational institutions, parents, teachers, administrators, and students, provided that they meet all eligibility requirements as outlined below. All users must be at least 18 years of age or have the explicit consent of a parent or guardian to create an account on the Platform. By registering for an account, you represent and warrant that you are eligible to do so under applicable laws and these T&C.

The Platform requires users to provide accurate, complete, and current information during the registration process. This includes, but is not limited to, providing a valid email address, phone number, and other necessary identification details. You agree to update your information promptly to ensure its accuracy throughout your use of the Platform. The Platform reserves the right to suspend or terminate any account where the information provided is found to be inaccurate, incomplete, or outdated.

Users under the age of 18 must obtain explicit permission from their parent or guardian to register an account. The Platform is not responsible for any use of the Platform by minors without the requisite consent. If it is found that a user under the age of 18 has created an account without such consent, the Platform reserves the right to suspend or terminate the account without any notice or liability.

3. Data Collection and Privacy

The Platform collects, stores, and processes various categories of personal data, including but not limited to user names, contact information, addresses, academic records, payment details (such as credit card and PayPal information), health records, and other sensitive information. By using the Platform, you consent to the collection and use of this data in accordance with our Privacy Policy, which is an integral part of these T&C.

The Platform complies with relevant data protection regulations, including but not limited to the **General Data Protection Regulation (GDPR)** in the European Union and the **Children's Online Privacy Protection Act (COPPA)** in the United States. We take every necessary step to protect your personal information from unauthorized access, use, disclosure, or destruction. In addition to internal data storage, the Platform integrates with third-party services for payment processing and hosting services. 4. User Responsibilities and Code of Conduct

As a user of the Platform, you are expected to conduct yourself responsibly, ethically, and in compliance with all applicable laws. Users are prohibited from using the Platform for illegal or unauthorized activities, including but not limited to harassment, bullying, copyright infringement, and uploading harmful or illegal content.

Communication between users, particularly with minors, must be conducted with caution and respect. Teachers, school administrators, and parents are responsible for ensuring that communications with students, especially those under the age of 18, are appropriate and adhere to all legal requirements. Any reports of inappropriate behavior will be taken seriously, and the Platform reserves the right to investigate, suspend, or terminate accounts involved in such activities.

Users are responsible for the content they upload to the Platform, whether it is text, images, documents, or other media. This includes ensuring that all uploaded content is lawful and free from copyright infringement. The Platform does not review content before it is uploaded but reserves the right to remove any content that violates these T&C or applicable laws. The Platform assumes no liability for user-uploaded content, and any legal consequences resulting from such content are the sole responsibility of the user who uploaded it.

5. Payments, Subscriptions, and Refunds

All payments for subscriptions, add-on services, and other paid features of the Platform are processed securely through **Stripe** or other approved payment providers. By making a payment through the Platform, you agree to abide by the terms of service of the third-party payment processor.

**Refunds** are not guaranteed and are granted at the sole discretion of the Platform. Users may request a refund, but the Platform reserves the right to offer a full, partial, or no refund based on the specific circumstances of the request. Factors such as policy violations, illegal activities, or misuse of the Platform may influence the decision to deny a refund.

School administrators are required to ensure timely payment of subscription fees. Failure to do so may result in the suspension or permanent deletion of the school's account and all associated data. The Platform reserves the right to delete school data and accounts without notice if subscription payments are not received on time. However, if a school contacts the Platform regarding payment issues, we may, at our discretion, provide an extension or delay the deletion process.

6. Account Suspension, Termination, and Data Deletion

The Platform reserves the right to suspend, terminate, or delete any account at its sole discretion, particularly in cases where users are found to have violated these T&C or engaged in illegal activities. The Platform is not obligated to provide an explanation or notice before taking such actions. Users whose accounts are suspended, terminated, or deleted are not guaranteed refunds or compensation.

If your account is suspended or terminated for reasons unrelated to policy violations, illegal activities, or misuse, the Platform may consider refunding the subscription fees. However, this decision is at the sole discretion of the Platform and will be handled on a case-by-case basis.

Users are responsible for maintaining backups of their own data. The Platform is not liable for any data lost due to account suspension, termination, or deletion, particularly when such actions are taken due to policy violations.

7. Copyright and Intellectual Property

All content uploaded by users remains the property of the user. However, by uploading content to the Platform, users grant the Platform a non-exclusive, royalty-free license to store, use, and display the content within the scope of the Platform's services. This license is required to enable the Platform to operate as intended.

Users are strictly prohibited from uploading copyrighted material without the appropriate permissions. If the Platform becomes aware of any copyrighted or illegal material being uploaded, it reserves the right to remove the content immediately and suspend or terminate the account responsible for the upload.

The Platform's content, design, code, and trademarks are protected by copyright, trademark, and intellectual property laws. Unauthorized use of any part of the Platform's intellectual property is strictly prohibited and may result in legal action.

8. Third-Party Services

The Platform integrates with third-party services, including but not limited to payment processors (such as **Stripe**) and hosting providers. While we strive to ensure that these services are secure and reliable, the Platform cannot guarantee uninterrupted access to third-party services. In the event of service disruptions or data loss caused by third parties, the Platform will work to resolve the issue but cannot be held liable for damages.

9. Data Loss and Recovery

In the unlikely event of data loss due to errors, system failure, or third-party service issues, the Platform will take reasonable steps to recover the lost data. If the hosting provider is responsible for the data loss, the Platform will pursue compensation from the provider. Any compensation recovered may be passed on to affected users in the form of refunds or subscription credits.

If the Platform itself is responsible for data loss, and the data is deemed irrecoverable, the Platform will refund the affected users for their subscription fees and offer a compensatory extension of services. However, no compensation will be offered if the data loss is caused by the user's violation of these T&C or other illegal activities.

10. Dispute Resolution and Arbitration

All disputes arising from the use of the Platform shall be resolved through **binding arbitration**. By agreeing to these T&C, you waive your right to bring any claims against the Platform in a court of law.
